Fake independence: So, Tinubu can tell EFCC what to do! By Olu Fasan, <\/p>\n

Some Nigerians commit the\u00a0delusional sin of believing that once a state institution has the word \u201cindependent\u201d prefixed to its name, it is, indeed, independent. They believe that critical state agencies created by statute or the Constitution to ensure security and law and order, to guarantee justice and rule of law, to safeguard electoral integrity and democratic norms and to fight corruption and malfeasance in public office do, in fact, discharge their responsibilities dutifully without fear and without favour, deliberately removed from presidential control. Now, however, everyone knows what has long been clear, thanks to President Bola Tinubu who recently shredded the deceptive fa\u00e7ade into pieces. That\u2019s how to interpret the president\u2019s recent \u201cdirective\u201d to the anti-graft agency, the Economic and Financial Crimes Commission, EFCC, to lift a freezing order it placed on the Osun State Government\u2019s statutory allocation account over alleged diversion of public funds.<\/p>\n

Perversely, some commentators praised the president for his \u201cshrewd\u201d intervention. Few considered the bigger picture; few saw the wider implication of a president inviting the country to accept he could and, indeed, would interfere in any state agency because \u201cas the president, the buck stops with me\u201d; few understood that wielding power in that manner comes straight from an autocrat\u2019s playbook. Tell me, what could be more corrosive of institutional independence than subjecting every agency to the whims of the president? The answer was less obvious from those who gave Tinubu a thumbs up for his action. I disagree! Why? Well, let\u2019s start with the facts. Last week, on August 5, the EFCC asked First Bank to freeze the Osun State Government\u2019s statutory allocation account, explaining later that \u201cwe observed in the past one week that activities on that account looked suspicious, so we took the step of placing a restriction on the account to preserve it.\u201d Given that the EFCC\u2019s action came just over a week to the state\u2019s governorship election, on August 15, it inevitably created perception of the agency acting on a partisan direction to favour the federal ruling party\u2019s candidate, who was the governor\u2019s main opponent. Governor Ademola Adeleke immediately sued the EFCC, accusing the agency of acting \u201cunlawfully\u201d. Ostensibly, one could argue, the EFCC acted as it felt it should, and the governor behaved as he should, swiftly taking the matter to court: the law must then take its course.<\/p>\n

But, alas, not so. President Tinubu intervened politically; in doing so, he went for the nuclear option. He ordered the EFCC to lift the order freezing the Osun State government\u2019s account and to \u201cdiscontinue whatever action it had instituted against the government\u201d. In a statement, dated August 6, which he personally signed, the president said: \u201cI must state that I feel deeply embarrassed not by the EFCC\u2019s exercise of its mandate, backed by a court order, but by the timing of the agency\u2019s action.\u201d That should have been a sufficient response, leaving the matter to the courts, but he went on: \u201cBased on the foregoing premise, I am duty-bound to issue a directive on this issue in consonance with the overriding public interest in preserving public confidence and the integrity and fairness of our democratic process.\u201d Consider the above statement closely. First, President Tinubu acknowledged the EFCC acted \u201cin the exercise of its mandate\u201d; second, he acknowledged the agency\u2019s action was \u201cbacked by a court order\u201d. But because he was \u201cdeeply embarrassed\u201d by \u201cthe timing\u201d of the action, he overrode the agency\u2019s mandate and quashed its court order. What about Governor Adeleke\u2019s suit challenging the EFCC\u2019s action? Why did the president think his political intervention was more appropriate than the judicial process? President Tinubu invoked \u201cthe overriding public interest\u201d. But where did the overriding public interest really lie in this case? Was it in a meaningless political grandstanding purporting to restore public confidence in the integrity and fairness of the Osun State governorship election when, in fact, everyone knew \u201cfederal might\u201d was ruthlessly deployed in other guises? Or was it in preserving the veneer of independence that the EFCC had hitherto clothed itself with? Sadly, that pretence to independence, to immunity from partisan influence, is now completely gone!\u00a0<\/p>\n

Truth is, President Tinubu acted as he did because he believes the EFCC is subject to his direction, and federal agencies must not make him \u201cfeel deeply embarrassed\u201d. Some already got the memo. For instance, in the \u201cfake agency\u201d case, once President Tinubu publicly declared \u201c100 per cent confidence\u201d in his top aides, the Independent Corrupt Practices and Other Related Offences Commission, ICPC, knew the president would \u201cfeel deeply embarrassed\u201d if it named the high-profile collaborators in the presidency. Hence, last week, the ICPC submitted a whitewash report that exonerated key suspects in the scandal, as if the fake agency created and enabled itself. But strong state institutions do, in fact, without intentionality, \u201cembarrass\u201d leaders. Take the US, whose system of government Nigeria claims to practise. While President Trump has no doubt been undermining US democratic guardrails, US institutions have fought back, often successfully. For instance, President Trump has lost several court actions, on tariffs, birthright citizenship, etc, which caused him huge domestic and international embarrassments. In 2020, Trump asked Georgia\u2019s Secretary of State, Brad Raffensperger to help him \u201cfind\u201d votes to beat Joe Biden. \u201cI just want to find 11,780 votes,\u201d Trump told Raffensperger. But he refused. How many election officials would reject such pressure in Nigeria? Also, amid concerns that Trump might use the military to stop Biden\u2019s inauguration in January 2021, the US Joint Chiefs of Staff issued a rare statement, saying: \u201cThe US military will obey lawful orders from civilian leadership.\u201d Can security forces in Nigeria vow to obey only lawful orders from an incumbent president during elections? Utterly doubtful.\u00a0<\/p>\n

To be sure, in a presidential system, the executive power is vested in the president, as stated in section 5(1) of the 1999 Constitution, and, as such, an executive agency cannot be so independent as to be free of presidential control. However, the US Supreme Court made a powerful distinction between \u201cexecutive\u201d and \u201cnon-executive\u201d agencies. The court held that executive or political agencies are those exercising executive powers or functions directly on behalf of the president; most agencies in Nigeria, such as the National Sports Commission, fall into this category. However, non-executive agencies are those whose duties are \u201cneither political nor executive but predominantly quasi-judicial and quasi-legislative.\u201d The EFCC and the CBN fall into the non-executive category, and the convention worldwide is that such agencies should be insulated from presidential control and operate at a distance from partisan politics. Which was why, recently, the US Supreme Court rejected President Trump\u2019s decision to fire Lisa Cook, a member of Board of Governors of the Federal Reserve System. The court argued that allowing Trump to sack Cook at will would violate \u201cour Nation\u2019s long tradition of independent central banking protected from political interference.\u201d<\/p>\n

Unfortunately, in giving orders to EFCC, President Tinubu implies he doesn\u2019t believe the anti-graft agency should be insulated from presidential control. Of course, past presidents used EFCC as a political tool, but they acted subtly. Tinubu\u2019s blatantly \u201cdirective\u201d to the EFCC replaces behind-the-scenes interference with open erosion of institutional independence and integrity. Put simply, President Tinubu is saying: \u201cEFCC is under my control, I can tell it what to do.\u201d But that strips the agency of the moral clout and legitimacy to act as a truly independent anti-graft body because EFCC\u2019s credibility lies not only in the fact of independence but also in the appearance of independence.<\/p>\n

Last year, in a piece titled \u201cEFCC\u2019s failure: Olukoyede\u2019s blame-shifting is mere shadow boxing\u201d<\/a> (Vanguard, February 13, 2025), I questioned the agency\u2019s independence. In a rejoinder titled \u201cOlukoyede\u2019s record-breaking strides in EFCC and Olu Fasan\u2019s errors of analysis\u201d, published in virtually all national newspapers, Dele Oyewale, EFCC\u2019s head of media and publicity, accused me of \u201cmud splashing\u201d. Well, if I ever needed vindication, President Tinubu\u2019s action has now provided it: EFCC is not truly independent!\u00a0<\/p>\n
